Special Education Compliance

Overview

The Utah State Board of Education (USBE) Special Education Services uses Utah Program Improvement Planning System (UPIPS) to monitor and support compliance with federal and state requirements in Local Education Agencies (LEAs) across the state of Utah. This system was developed and designed to mirror the system used by the federal Office of Special Education Programs (OSEP) to monitor each state. UPIPS encompasses both external monitoring by the USBE Special Education Services and internal monitoring by the LEA. The purpose of UPIPS is to use continuous monitoring to improve procedural compliance and outcomes for students with disabilities. This data-driven approach to monitoring provides a systematic way for the USBE Special Education Services and the LEA to evaluate the impact special education services are having on student achievement and outcomes.

Residential Treatment Centers (RTC)

The Utah State Board of Education (USBE) Special Education Services has the responsibility of monitoring compliance with federal and state requirements under the Individuals with Disabilities Education Act (IDEA) of 2004. This responsibility is administered within the framework of supporting positive results for students with disabilities.

In accordance with the USBE Administrative Rule R277-926: Certification of Residential Treatment Center Special Education Program, an Onsite Monitoring visit will be conducted at each RTC to determine compliance with this USBE Rule. All RTCs found compliant will be awarded a two-year certification.

When a Local Education Agency (LEA) places a student in an RTC, The RTC is responsible for providing a Free Appropriate Public Education (FAPE) to that student. The USBE certifies RTCs to provide the LEA with an assurance that the RTC has the systems and personnel in place able to provide a FAPE.

In order to become certified through the State of Utah, an RTC submits an application for initial or renewal certification, the application is reviewed and accepted, and an on-site visit is completed to verify the information submitted with the application. Several methods of data collection are utilized during the on-site visit including reviewing student records, interviewing school staff and parents, and conducting classroom observations in both general and special education settings. The results of that visit are presented in a report.
