Board Rule Waivers

Overview

Pursuant to R277-121, Board Waiver of Administrative Rules, an LEA board may request a waiver from a Board rule by filing a written request.

To request a waiver, please email AAG Ashley Biehl a completed copy of the completed Waiver Request Application along with all supporting materials and required data as outlined. In most cases, the waiver request must first go before the LEA Board and pass with a favorable recommendation, and the formal minutes documenting that vote must be provided. In the case of charter schools, the application must be voted upon favorably by the Charter school’s authorizing board. Once the application has been reviewed by AAG Ashley Biehl, the request will be heard at an upcoming Board Committee meeting. These are typically held the first Friday of each month. If approved by the Committee, the request will go before the full Board at the following month’s Board Meeting. These meetings are typically held the first Thursday of each month. Please note that Board Waivers related to a 4-day school week must be submitted to AAG Ashley Biehl no later than April 10th to be applied to the upcoming school year (I.e., If the waiver request is to begin with the 2025-2026 school year, the application will need to be submitted by April 10, 2025.)

Additional Notes:

Board Waivers are typically for a period of three years, except for waivers related to construction, weather, etc. An LEA may seek a waiver directly from the Superintendent of Schools IF: the LEA closes due to excessive snow, inclement weather or another emergency, which will result in the LEA not meeting the 180-day requirement.
