Description

Purpose

The purpose of this agreement is to reimburse Utah State Board of Education (USBE) for costs incurred in providing student information data to DWS , which allows DWS to utilize the data in order to issue Summer Electronic Benefit Transfer (EBT) benefits to eligible students.

Legal Authority

34 CFR § 99.31, 34 CFR § 99.36, and 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Health and Safety Emergency Exception” of the Family Education Rights and Privacy Act (FERPA).

Child Nutrition and WIC Reauthorization Act of 2004
This law is relevant as it provides the legal basis for sharing data to determine direct certification for programs like Summer EBT.
