Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and State of Utah Department of Workforce Services (DWS) is to provide support services to members of the Utah Assistive Technology Teams (UATT) in the public schools of Utah. The UATT teams will function as prescribed in the April 2022 UATT Policy and Procedure Manual. Staff members will consist of a full-time employee (Trainer) and a half-time employee (Project Director) who will conduct the day-to-day activities of the project under the Department of Workforce Services (DWS) at the Utah Center for Assistive Technology (UCAT).

Legal Authority

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).

Individuals with Disabilities Education Act (IDEA) 34 CFR 300.154(a)
Requires all public schools to provide a Free Appropriate Public Education (FAPE) for children with disabilities

Utah Code Section 53E-1-201
Subsequent sections define the purpose and components of the state's public education system, which supports the provision of special education services.
