Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and Utah State University is to provide special education technical assistance activities along with salary, benefits, professional and technical services, travel, supplies and materials, and indirect costs as needed to Utah State University on behalf of the Center for Technical Assistance for Excellence in Special Education (TAESE).

Legal Authority

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).

Individuals with Disabilities Education Act (IDEA)
This is the primary federal law that makes available a free appropriate public education (FAPE) to eligible children with disabilities and ensures special education and related services. It also requires states to develop plans and provide technical assistance, which is the basis for the interagency agreement.

Section 504 of the Rehabilitation Act of 1973
This civil rights law prohibits discrimination based on disability and requires that programs and services be accessible to students with disabilities. It is also cited as a legal basis for the interagency agreement, especially regarding transition services and employment outcomes.

Utah Code Annotated (UCA) 53E-3-401(4) and 53E-3-501
These statutes grant the Utah State Board of Education (USBE) the authority to create rules and standards for special education services to fulfill its duties under federal and state law.
