Description

Purpose

The purpose of this contract between the Utah State Board of Education and Special Education Consulting Services is to provide Individuals with Disabilities Education Act (IDEA) dispute resolution services. Applicable laws require the State of Utah to provide certain dispute resolution resources to such families at no cost. Accordingly, the Utah State Board of Education (USBE) is entering into this Contract with Special Education Consulting Services to be the Individualized Education Program (IEP Facilitator).

Legal Authority

34 CFR § 99.31(a)(3), 34 CFR § 99.35, 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Audit and Evaluation Exception” of the Family Education Rights and Privacy Act (FERPA).

53E-7-208- Special Education Dispute Resolution 
Utah law specifically addresses special education dispute resolution, rulemaking, due process hearings, and the right to appeal. It mandates that the Utah State Board of Education (USBE) make rules to allow for prompt, fair, and final resolution of disputes related to special education, establish procedural safeguards meeting the requirements
