Description

Purpose

The purpose of this Memorandum of Understanding is to address how the Utah Department of Health and Human Services, Baby Watch Early Intervention Program and the Utah State Board of Education, through its Special Education Services Section, will meet the Part C to Part B transition requirements of the Individuals with Disabilities Education Act (IDEA).

Legal Authority

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).

34 CFR § 99.31(a)(3), 34 CFR § 99.35, 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Audit and Evaluation Exception” of the Family Education Rights and Privacy Act (FERPA).

Individuals with Disabilities Education Act (IDEA)
Specifically, Part C and Part B of IDEA, which govern early intervention services and special education services for school-aged children, respectively
20 U.S. Code § 1416(a)(3)(B): This section of the IDEA mandates that states must ensure that children transitioning from Part C to Part B have an IEP developed and implemented by their third birthday
34 CFR § 300.301(d): This regulation outlines exceptions to the evaluation timelines, including parental refusal to provide consent.
34 CFR § 300.149: This regulation requires states to monitor local education agencies (LEAs) for compliance with IDEA, including the transition from Part C to Part B
