Individuals with Disabilities Education Act (IDEA)
Specifically, Part C and Part B of IDEA, which govern early intervention services
and special education services for school-aged children, respectively
20 U.S. Code § 1416(a)(3)(B): This section of the IDEA mandates that states must ensure that children transitioning
from Part C to Part B have an IEP developed and implemented by their third birthday
34 CFR § 300.301(d): This regulation outlines exceptions to the evaluation timelines, including parental
refusal to provide consent.
