Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and Utah State University (USU) is to provide on-demand supports to improve the skills, knowledge, and experience of school staff serving students with challenging behavior to improve student access to least restrictive environments.

Legal Authority

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).

Data Shared included relevant data points for the implementation supports to improve the skills, knowledge, and experience of school staff serving students with challenging behavior to improve student access to least restrictive environments. USU will have access to all of a referred student’s special education data. They will have an educational need to know about the student’s special education program as they will be providing support to the student’s IEP team about the student’s behavior.
