Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and Department of Health and Human Services Juvenile Justice and Youth Services(JJYS) is to provide key educational services and products to youth who are in the state custody during out-of-school hours to aid them to acquire educational opportunities that students not in state custody acquire during school hours; also, to aid students in custody to gain positive marketable skills that will enhance positive outcomes post release.

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).
