Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and Department of Workforce Services (DWS) is to reimburse USBE for allowable administrative costs incurred in providing student information data to DWS under Data Sharing Agreement #20- MOU-0176, which allows DWS to utilize the data to determine household eligibility for Pandemic Electronic Benefits Transfer (EBT).

Legal Authority

34 CFR § 99.31, 34 CFR § 99.36, and 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Health and Safety Emergency Exception” of the Family Education Rights and Privacy Act (FERPA).

Section 4601 of the Continuing Appropriations Act, 2021
Allows for reimbursement of allowable administrative costs incurred by the agencies within each State that operate the Supplemental Nutrition Assistance Program (SNAP) and the Child Nutrition National School Lunch Program.
