Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and Department of Workforce Services (DWS) and Utah Center for Assistive Technology (UCAT) is to support federal and state regulations that require the Individualized Education Program (IEP)/504 team consider the students' needs for assistive technology devices and services. IEPs/504s should clearly reflect the assistive technology (AT) needed and describe the manner in which it will be used, as well as the supports required to administer it.

Legal Authority

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).

Free Appropriate Public Education (FAPE) as required by Section 504 of the Rehabilitation Act 34 C.F.R. Part 104.33

Individuals with Disabilities Education Act (IDEA): 34 CFR Part 300.105(b)
