Description

Purpose

The purpose of this Memorandum of Understanding between the Utah State Board of Education (USBE) and Utah Data Research Center (UDRC) is to outline the general provisions for USBE to share data with UDRC under the Utah Data Research Center Act.

Legal Authority

34 CFR § 99.31(a)(3), 34 CFR § 99.35, 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Audit and Evaluation Exception” of the Family Education Rights and Privacy Act (FERPA).

Utah Code Annotated § 53B-33-101
Specifically authorizes UDRC to collect and hold data from “Participating Entities”

Utah Code sections 53B-1-109(2) and 53E-4-308(3) through (5)
Parties are required to coordinate to allow individual student academic achievement to be tracked through both the public and higher education systems including coordinating access to the unique student identifier of a public education student who later attends an institution within USHE.
