Description

Purpose

The purpose of this contract between the Utah State Board of Education and WestEd is to provide mapping and cataloging of Utah State Board of Education (USBE) K12 and postsecondary Utah System of Higher Education (USHE) pathway programs.

Legal Authority

34 CFR § 99.31(a)(3), 34 CFR § 99.35, 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Audit and Evaluation Exception” of the Family Education Rights and Privacy Act (FERPA).

Utah Code § 53E-9-308
Specifically addresses the sharing of student data by educational entities. It permits sharing for research or evaluation purposes, provided that the data manager verifies the request meets federal requirements, the request goes through a research review process, and all resulting instructions are fulfilled.
