Description

Purpose

The purpose of the Data Sharing Agreement between the Utah State Board of Education(USBE) and Utah Department of Health (UDOH) is to conduct evaluation and analysis for USBE in order to improve the quality of instruction and education in Utah; and conduct investigation and analysis in order to meet reporting requirements of federal programs. The Parties will contribute to a multi-agency research study that collects, analyzes, and provides state-level information regarding the occurrence of Autism Spectrum Disorder (ASD) and Developmental disabilities (DD) in order to investigate prevalence, diagnostic patterns, special education classifications, and risk factors for ASD with a goal of making educational improvement recommendations to USBE and UDOH.

Legal Authority

34 CFR § 99.31(a)(3), 34 CFR § 99.35, 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Audit and Evaluation Exception” of the Family Education Rights and Privacy Act (FERPA).
