Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and Utah Department of Health is a function of providing Medicaid reimbursement for the rendering of covered related services in participating Local Education Agency’s (LEAs) to Medicaid members, the State requires this data to determine the portion of students enrolled in LEAs that are enrolled in Medicaid.

Legal Authority

34 CFR § 99.30, 20 U.S. Code § 1232g(b)(1), and 20 U.S. Code § 1232g(b)(2)(A). This data sharing is permitted under the parent consent provisions of the Family Education Rights and Privacy Act (FERPA).

Utah Code Section 26B-5-113
This section of the Utah Code specifically addresses the coordination between the Department of Health and USBE regarding Medicaid reimbursement for school-based health services and the potential for expanding these services beyond those specified in IEPs.

Individuals with Disabilities Education Act (IDEA)
This law mandates that interagency agreements be in place to ensure coordination and payment for health services provided to students under IDEA.

Social Security Act (specifically Title XIX, governing Medicaid)
This act and its related regulations dictate the requirements for Medicaid reimbursement, including for services provided in schools.
