Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education (USBE) and Utah Department of Health is due to the Utah Department of Health (UDOH) being authorized to collect Data from USBE under Utah Code 26-6-3 when necessary in undertaking public health efforts to interrupt transmission of COVID-19 infections in the school environment, throughout the school population and to others having contact with school populations.

Legal Authority

34 CFR § 99.31, 34 CFR § 99.36, and 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Health and Safety Emergency Exception” of the Family Education Rights and Privacy Act (FERPA).
