Description
Purpose
The purpose of this research sharing agreement between the Utah State Board of Education
(USBE) and ETS (Educational Testing Service) is to work with Language Testing International,
Inc. (“LTI”) to combine student test result data from ACTFL tests and Praxis® tests
under one Title II Report for the 2020/21 academic year. ETS needs to secure approval
to receive student data for the ACTFL tests from LTI in electronic format so that
ETS may, through the use of its proprietary Title II Reporting Application, create
a consolidated Title II Report. ETS will require that LTI encrypt the data prior to
any transfer to ETS. LTI has a direct relationship with Utah State Board of Education
(USBE) to provide the ACTFL tests, LTI must also secure approval in order to release
the ACTFL test data to ETS.
Legal Authority
34 CFR § 99.31(a)(6) and 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Studies Exception” of the Family Education
Rights and Privacy Act (FERPA).
