Description

Purpose

The purpose of this Memorandum of Understanding between the Utah State Board of Education and Utah Department of Human Services, Division of Child & Family Services (DHS-DCFS) is to provide direct certification for certify children who are legal wards of the State of Utah to be eligible for free school meals based on information provided by DHS-DCFS.

Legal Authority

34 CFR § 99.31, 34 CFR § 99.36, and 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Health and Safety Emergency Exception” of the Family Education Rights and Privacy Act (FERPA).
