Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education and GEAR UP is to provide services and assistance for low-income students in order to help them successfully graduate from high school and prepare for college. It is an acronym for Gaining Early Awareness and Readiness for Undergraduate Programs. The data received through USBE will be used for mandated federal reporting, and student support.

Legal Authority

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).

Higher Education Act of 1965
Specifically the 1998 amendments and the corresponding federal regulations (34 CFR Part 694) governing the GEAR UP program. Gaining Early Awareness and Readiness for Undergraduate Programs.
