Description

Purpose

The purpose of this contract between the Utah State Board of Education and Renaissance Learning Inc. is to provide common academic assessment for Utah Youth in Custody Education Program. According to Utah Code, the Utah State Board of Education (USBE) is directly responsible for the education of students who are in the custody of or receiving certain services from the State of Utah. USBE fulfills this obligation by contracting with school districts to provide education services, however, USBE retains responsibility for these programs. To improve consistency in monitoring and evaluating Youth-in-Custody (YIC) programs that the Board oversees, it has become necessary to adopt a common academic assessment tool for the students in these programs.

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).
