Description

Purpose

The purpose of this interagency agreement between the Utah State Board of Education and University of Utah is for , the USBE Youth in Care (YIC) Program has partnered with the University of Utah (UU)’s School of Biological Sciences (SoBS) to support the STEM (science, technology, engineering, math) Community Alliance Program (STEMCAP). This program implements meaningful STEM project based learning activities and workshops for students in juvenile correctional facilities and residential treatment programs in Utah. These educational programs bring research scientists, educators, and graduate students directly into YIC classrooms to effectively teach STEM core concepts, encourage research awareness, inspire vocational interests, fuel creativity, and significantly improve educational achievement and outcomes for youth in care. This agreement will continue this highly successful alliance with the UU and incrementally expand this work to more YIC students and with more activities, and more community partners in 2020-2025, with accompanying evaluation and assessment of all collaborators.

Legal Authority

34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family Education Rights and Privacy Act (FERPA).

Utah Administrative Code R277-709
Administrative rule specifically outlines the requirements for education programs serving youth in care. This rule supports the goal of the agreement to provide meaningful educational opportunities for students in juvenile correctional facilities and residential treatment programs.  

53E-3-503- Education of Individuals in Custody
Outlines the requirement for the Utah State Board of Education to coordinate with the Department of Health and Human Services to plan and coordinate educational programs for individuals in the custody of certain state agencies, including juvenile justice services. This legislation establishes a framework for the type of interagency collaboration outlined in the agreement.

No data are shared by USBE. At the Juvenile Justice and Youth Services Facilities, small amounts of student data sharing may occur incidentally as a part of students' participation in the STEMCAP program. This would include sharing students' names with STEMCAP staff.
