Purpose
The purpose of this contract between the Utah State Board of Education and WestEd
is to provide Special Education Fiscal Coaching Services to LEAs.
Legal Authority
34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family
Education Rights and Privacy Act (FERPA).
Utah Code Section 53E-7-209
Allows LEAs to use state special education funds to provide an LEA special education
program, including related services and support. While this directly addresses funding
for services to students, it establishes a broader framework for LEAs to receive support
related to special education.
