Description
Purpose
The purpose of this interagency agreement between the Utah State Board of Education
and Utah's Division of Juvenile Justice Services is to provide key educational services
and products to youth who are in state custody during out-of-school hours in order
to aid them to acquire educational opportunities that students not in state custody
acquire during school hours.
Legal Authority
34 CFR § 99.31(a), 20 U.S. Code § 1232g(b). This data sharing is permitted under the “School Official Exception” of the Family
Education Rights and Privacy Act (FERPA).
Utah Code Section 53E-3-503
Utah Code R277-709: Education Programs Serving Youth In Care
Elementary and Secondary Education Act (ESEA) Title I, Part D:
Federal law that provides funding and support for the education of students in state
and local correctional facilities, as well as students in other institutions for neglected
or delinquent children. It aims to ensure these students have access to educational
services that are comparable to those offered in traditional public schools.
