Description

Purpose

The purpose of this agreement between the Utah State Board of Education and Department of Workforce Services sets out the requirements for direct certification and direct verification in consideration of the Child Nutrition and WIC Reauthorization of 2004 (Public Law 108-265) for the agencies administering. The Utah Government Records Access management Act permits private or controlled records to be provided to another governmental entity if it is necessary to the performance of that entity's duties.

Legal Authority

34 CFR § 99.30, 20 U.S. Code § 1232g(b)(1), and 20 U.S. Code § 1232g(b)(2)(A). This data sharing is permitted under the parent consent provisions of the Family Education Rights and Privacy Act (FERPA).
