Description

Purpose

The purpose of this Memorandum of Understanding between the Utah State Board of Education (USBE) and Utah Department of Workforce Services (DWS) is in order to facilitate information sharing and access to and disclosure of Intergenerational Poverty (IGP) information for the completion of the IGP report as required by legislation and other IGP programs created by the legislature.

Legal Authority

34 CFR § 99.31(a)(3), 34 CFR § 99.35, 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Audit and Evaluation Exception” of the Family Education Rights and Privacy Act (FERPA).

Utah Intergenerational Poverty Mitigation Act (Utah Code - Title 35A Chapter 9)
This law requires DWS to "establish and maintain a system to track intergenerational poverty to identify groups that have a high risk of experiencing intergenerational poverty" and "identify incidents, patterns, and trends that explain or contribute to intergenerational poverty" and "assist case workers, social scientists, and government officials in the study and development of effective and efficient plans and programs to help individuals and families break the cycle of poverty.

USBE will provide DWS indicators calculated from aggregating the match data. Indicators provided to DWS will be broken out by cohort type and will include:

• ELA SAGE Proficiency by LEA

• Graduation Rate by LEA
• Total matches by School
• ELA SAGE Proficiency by School
• Math SAGE Proficiency by School Grad Rate by School
• Total matches for child homelessness
