Memorandum of Understanding

Description

Purpose

The purpose of this Memorandum of Understanding between the Utah State Board of Education (USBE), Utah Department of Workforce Services (DWS) , and Utah State Office of Rehabilitation (USOR) is to enter into an information sharing agreement governing access to and disclosure of information for evaluating and reporting education and workforce information for common clients.

Legal Authority

34 CFR § 99.31(a)(3), 34 CFR § 99.35, 20 U.S. Code § 1232g(b). This data sharing is permitted under the “Audit and Evaluation Exception” of the Family Education Rights and Privacy Act (FERPA).

Utah Code Annotated Subsection 636-2-206(2)

Workforce Innovation and Opportunity Act, 29 USC§ 3122(d)(ll)(B), and§ 3123(b)(14)
requires the local workforce development board to coordinate activities with education  and training providers, including local agencies administering plans under title I of the Rehabilitation Act of 1973, and enter cooperative agreements with such entities to enhance the provision of services to individuals with disabilities, including sharing of information regarding individuals with a barrier to employment.
